On March 23 the head of the Department of Legal Analysis Anatoly Chehun together with the Chief Consultants of the Departments of Legal Analysis and International Connections took part in the round table “The Property Rights of IDPs in Ukraine” organized at the Cassation Administrative Court in the Supreme Court of Ukraine.
The participants of the round table were the Head and judges of the Cassation Administrative Court, the secretary of the court chamber on protection of social rights by CAC, the Head and specialists of the United nations Human Rights Monitoring Mission in Ukraine, the manager and experts of the project “Strengthening the protection of the human rights of internally displaced persons in Ukraine”, Deputy Director of the Office of the State Representative of the Interstate Affairs of the Secretariat of the Ombudsman for the European Court of the Human Rights, Deputy Head of Pension Fund of Ukraine, Deputy Director of legal Department of the Pension Fund of Ukraine, the Сoordinator of the technical group on property rights, housing and land rights, the manager of the Program on legal reforms issues of OSCE in Ukraine, Legal Advisor of the Office of UN High Commissioner for Refugees in Ukraine.

At the round table meeting it was discussed the issues of property and social rights of the citizens of Ukraine, the compensation for destroyed property and national and international mechanisms of protection of the above mentioned rights. The participants analyzed the international experience, the international standards and practice of European Court of Human Rights on protection of IDPs’ property rights.
In the cause of the round table the highlighted urgent issues were the ensuring the property rights of IDPs and prospects of the development of the mechanism of compensation for destroyed property caused at the mainland and occupied territories. Under the monitoring of the realization of property rights of the citizens of Ukraine, living in the TOT and analyzing the citizens’ complaints to the Mission there is, indeed, a problem in the following issues.
First of all it is a repayment of deposits to depositors who lived in Crimea upon its occupation. The urgent challenges remains the realization of property rights and replacement of personal possessions from/to the TOT and other territory of Ukraine. The other problem to be decided is the protection of property rights of the citizens living in the TOT in ARC in the court by secondary legal assistance.
It was discussed the activity of the Mission in developing the Drafts Law amending the current legislation on property rights of IDPs.
