Ukrainian President Petro Poroshenko has signed decree No. 390/2018 dated 26 November, which enacts the decision of the National Security and Defense Council (NSDC) “Regarding Extraordinary Measures on Ensuring the State Sovereignty and Independence of Ukraine and the Introduction of Martial Law in Ukraine”. The decision of NSDC of Ukraine defines that the actions of the Russian Federation against the military boats of the Marine Forces of the Armed Forces of Ukraine have resulted in serious consequences, which constitute a crime of military aggression, determined by the paragraphs “c” and “d” article 3 of the of UN General Assembly Resolution 3314 (XXIX).
The document recognizes the need to introduce the martial law in Ukraine to create the conditions for the resistance to the military aggression, ensuring national security, eliminating threats to the state independence, sovereignty and territorial integrity of Ukraine. The President of Ukraine was recommended that martial law be imposed for 60 days from 26 November 14.00 p.m. until 25 January 2019. The above-mentioned decision also requires the Ministry of Foreign Affairs of Ukraine to appeal to our states-partners under the Memorandum on Security Assurances in connection with Ukraine’s accession to the Treaty on the Non-Proliferation of Nuclear Weapons, dated 5 December 1994 with the proposal to organize the consultations on the act of military aggression against Ukraine, to be a convene of a meeting of the UN Security Council, the Permanent Council of the Organization for Security and Co-operation in Europe (OSCE) as well as to organize the consultations of the President of Ukraine, Ministry of Foreign Affairs of Ukraine with the leaders of other states, European Union, leadership of UN and OSCE and other international organizations.
Ministry of Foreign Affairs of Ukraine, Ministry of Information Policy of Ukraine must launch an information campaign to bring an objective information on the act of armed aggression of the Russian Federation against Ukraine to the leadership of foreign states, powerful international, politic, economic and public societies. NSDC requested the Ministry of internal affairs of Ukraine, the Security Service of Ukraine to undertake all urgent measures to ensure public order, security and defense of the objects of critical infrastructure, protection of diplomatic and consul missions. The Administration of the State Border Guard Service was requested to enhance security of the State border with Russian Federation and the administrative boundary line with the Autonomous Republic of Crimea.
The decision of the NSDC “Regarding Extraordinary Measures on Ensuring the State Sovereignty and Independence of Ukraine and the Introduction of Martial Law in Ukraine” also includes the instructions for the appropriate central executive authorities, military commissariats, law enforcement bodies to create the conditions for the state bodies, self-governmental bodies, enterprises, establishments and organizations to exercise their powers to protect the territorial indivisibility of Ukraine against threat.
