On the 04th day of December, 2017, the Office of the Prosecutor of the International Criminal Court (ICC) published a Report on Preliminary Examination Activities for the year 2017, its Articles 79-120 concern the investigation of events in Crimea and the Eastern Ukraine that had been happening since February 20th, 2014 and showing signs of military crimes and happening in the context of interstate conflict between Ukraine and the Russian Federation. In the report for the year 2017 the Prosecutor of the ISS points to such alleged violations of the Statute of the ISS in Crimea as killing by “self-defense” formations, cruel treatment, compulsory calling up for military service in the armed forces of the Russian Federation, violation of the right to fair trial, movement of part of the population of the Russian Federation to Crimea and the population of Crimea outside its borders, force capture of public property and part of private property by the invaders, harassment and intimidation of the Crimean Tatars and prohibition of Mejlis as a form of coercion to abandon Crimea.
The report noted that the Office of the Prosecutor of the ISS will continue interacting with the Ukrainian authorities, civil society and other interested parties in relation to all the issues connected with the preliminary examination of the case “Situation in Ukraine”. The Office of the Prosecutor will continue a detailed analysis of alleged crimes, being strictly guided by the provisions of the Statute of the ISS, in order to make a sound conclusion on the issues of jurisdiction of the ISS in this case. In the light that Ukraine has recognized the jurisdiction of the ISS for an unlimited period, the Office of the Prosecutor continues to register the allegations, in particular from individuals-natural persons, of crimes committed in Crimea, to the maximum extent allowed by the jurisdiction of the International Criminal Court.
