Internally displaced person is a citizen of Ukraine, foreigner or stateless person who resides on the territory of Ukraine on legal grounds and has the right to permanent residence in Ukraine, and who is forced to leave his/her place of residence as a result of the temporary occupation of the Autonomous Republic of Crimea and the city of Sevastopol.
The fact of internal displacement is confirmed by the internally displaced people (IDP) registration certificate which is valid unlimitedly, with the exception of the cases provided for by the Law of Ukraine “On ensuring of rights and freedoms of internally displaced persons ” (hereinafter – the Law).
To obtain the IDP certificate a person has to submit a registration application to the department of social protection of the population in mainland Ukraine, and a minor child, a disabled person or a person with limited capacity – by a legal representative.
On behalf of a minor child who arrived unaccompanied by legal representatives his/her relative (grandmother, grandfather, great-grandmother, great-grandfather, brother or sister of full age, aunt, uncle), or stepfather, stepmother, with whom a child lives, may submit an application. In case of absence of relatives, the application is submitted by representative of the guardianship at the place of the child’s residence.
On behalf of a child, enrolled in childcare institution, health care or children social care institutions of full social security, the application is submitted by the head of the corresponding institution.
Together with the application the identification document and the document confirming the Ukrainian citizenship, or the identification document which confirms the person’s special status or the child’s birth certificate is submitted.
In case the application is submitted by the legal representative or the person’s relatives, or by the representative of the corresponding institution the following documents are attached additionally.
In accordance with the law in case of the absence of the registration mark indicating the residence on the territory of the Autonomous Republic of Crimea or the city of Sevastopol in the person’s document, the applicant has to present evidence confirming the fact of residence in Crimea on the day of the beginning of the temporary occupation.
This evidence is considered to be:
• military registration card with information about military service;
• employment record book with records about professional experience;
• document confirming the right of ownership of personal or real estate;
• certificate of general secondary education;
• certificate of completed general secondary education;
• certificate of technical and vocational education;
• document of higher education (academic degree);
• proof of student status;
• medical documents, photographs, video records etc.
In this case social protection agency has to consider the application within 15 working days and decide upon whether to award certificate to the applicant or refuse the certificate with the obligatory indication of the grounds for refusal.
The citizens of Ukraine who have filed the application concerning the registration of internally displaced persons and haven’t obtained the IDP certificate, and regard that their rights have been violated, have the right to free secondary legal assistance in concluding service documents or to the service of representation of people’s interests in resolving the issues connected with the obtaining of this certificate.
